Abstract

Abstract The Iraqi Personal Status Law regulates divorce which can take a variety of forms, some initiated by the husband, and some initiated by the wife. This includes divorce by authorization according to it a husband can delegate the right of repudiation to his wife. However, the law does not regulate this type of divorce, and Article 1, 2 and 3 of the personal status which refer to the Islamic jurisprudence, are not sufficient to address the issue with all the differences.
