دور القضاء الاداری فی المنازعات الاقتصادیة (دراسة مقارنة)

الملخص
تجادل هذه الورقة بأنه استجابة لسیاسة الإصلاح الاقتصادی الجدیدة فی العراق التی تم إطلاقها فی العقد الماضی، یجب أن یکون لمجلس الدولة العراقی سلطة قضائیة حصریة على النزاعات الإداریة والاقتصادیة. اذ یمکن لمجلس الدولة، من حیث دوره کجهة استشاری للحکومة والبرلمان، ودوره باعتباره أعلى محکمة إداریة، أن یکون له دور رئیسی فی تحسین الحوکمة والممارسات التنظیمیة الأخرى للدولة لاسیما تلک المتعلقة بالمنازعات الإداریة والاقتصادیة مع المستثمرین. بهدف المضی قدمًا فی هذا التحلیل، سنقوم بدراسة امکانیة أن یضمن دور مجلس الدولة هذا عملیة تسویة أسرع وأقل تکلفة لنزاعات الاستثمار مقارنةً بالتحکیم الدولی من ناحیة، وان یلبی الاحتیاجات التنمویة للبلد من ناحیة اخرى. ترکز هذه الدراسة على الطریقة التی یتم بها التعامل مع الخلافات الاقتصادیة والإداریة مع المستثمرین حالیا بموجب القانون العراقی حیث لا توجد محاکم إداریة ذات اختصاص عام فی المنازعات الاقتصادیة. . وینظر على وجه التحدید فی الطریقة التی یمکن لدور مجلس الدولة أن یساهم بها فی سیاسة الإصلاح. فی هذا السیاق، تقترح هذه الورقة عددًا من الحلول لتسویة مقبولة بین المستثمرین والدولة.
