الضمانات القانونیة لممارسة المحامی مهام التوثیق

الملخص

تعد مهنة المحاماة من المهن العریقة التی یحتاجها الانسان فی المجتمع منذ ادراک البشر الحریة والحق وانصرافهم عن حل منازعاتهم بالقوة، لما تحمله مهنة المحاماة من رسالة سامیة تتمثل بکفالة حق الدفاع عن الموکل والعمل على تحقیق العدالة، الا بعض القوانین لم تقصر ممارسة المحامی للمهام المذکورة اعلاه بل فضلا عن ذلک سمحت للمحامی ووفق ضوابط معینة ممارسة مهام الکاتب العدل، وذلک لمواجهة العدید من الاشکالیات منها قلة اعداد الکتاب العدول مقارنة بأعداد السکان، وکذلک ایجاد فرص عمل للخریجین من کلیات الحقوق، واخیرا التسهیل على المواطنین خصوصا الذین یسکنون الاماکن النائیة التی لا یتوفر فیها دائرة کاتب العدل، الامر الذی یجنبهم مشقة السفر والعناء، الا انه لابد لمنح المحامی صلاحیة التوثیق توفر العدید من الضمانات والتی اخذت بها القوانین المقارنة لتکفل تحقق الثقة فی شخص المحامی والمحافظة على حقوق الافراد، لذا وبناء على ما تقدم فإننا ندعو المشرع العراقی الى سلوک ذات الاتجاه الذی اخذت به هذه الدول لما فیه من فائدة للجمیع.
