الملخص

بغیة تحقیق السیادة الشعبیة من خلال التمثیل النیابی بواسطة ممثلین یختارهم الشعب وفق رغباته وکی لا یضیع صوت الناخب ورغبته التی وضعها فی مرشح کونه مستقلاً أو ینتمی الى حزب معین بسبب تغیر الانتماء الحزبی للنائب بعد انتخابه ، ومن اجل منع حالات الرشوة والفساد التی تقوم بها الاحزاب لإقناع اعضاء البرلمان لتبدیل انتمائهم الحزبی  والذی بدوره یؤثر على التوازن فی التمثیل الناتج عن اصوات الناخبین، کون الغالب ان الناخبین یقترعون لصالح المرشحین بحسب انتماءاتهم الحزبیة اکثر من الاقتراع على اساس الصفات الشخصیة والفردیة للمرشح لابد من مساءلة النائب عن تبدیل انتمائه الحزبی بعد انتخابه. ولمعالجة هذه المسألة قسمنا البحث الى ثلاث مباحث تناول الاول التعریف بالمسؤولیة، بینما خص المبحث الثانی إجراءات المسؤولیة الحزبیة لعضو البرلمان وحدد المبحث الثالث جزاء المسؤولیة الحزبیة لعضو البرلمان.
